SCHEDULING

5 to 7 days before your order’s anticipated arrival, a scheduler will call you to confirm your finalized ship date or delivery date, depending on ship via.  Please keep in mind the order does not go into production until an exact delivery date is set up with our scheduler.  It is recommended that the customer does not begin any demolition or remodel work in their kitchen prior to delivery and inspection of new cabinet.  This is important, as missing or damaged parts may delay installation.

BACKORDERS

In Stock Kitchens makes every effort to retain all products offered in stock. However, due to circumstances beyond our control, at times some products may be backordered.

At the time of sale your Designer will advise you of any backordered products and their estimated arrival dates. You will then have two options:

  • “Ship Complete” – shipping complete means that you are aware of the backorders and wish to have the order shipped in full, once all backorders are in stock. Our scheduler will set the delivery date based on the ETA of the backordered cabinets.
  • “Ship with Backorder” – shipping with backorders means that you are aware of the backorders and wish to have the order shipped in stages (additional shipping charges may apply).

In Stock Kitchens does not hold or guarantee product on orders that are over 3 months old and do not have full payment.  This acknowledgement serves as confirmation that you are aware of In Stock Kitchens backorder policy and understand that if there are backorders on your purchase it may delay the installation.

DELIVERY

Once your order leaves our warehouse it travels to a local terminal. You will then receive a call to schedule the time and date of your delivery. Please arrange for someone to be present at the delivery address during that time frame.  The drivers do not inspect the cabinets during the delivery.  This is done prior to delivery, before items are loaded onto the truck.  As this is an outsourced delivery service the cabinets will be brought to the first threshold of the delivery address and carried up no more than 3 steps.  Please make your designer aware of any special circumstances for your delivery.

To ensure a smooth delivery, we ask for the following items

  • A clear path to the main entrance of the home and to where your cabinets will be stored (e.g. garage living room, or kitchen). *Please note: Assembled Lazy Susans require a minimum doorway clearance of at least 34 inches*. If the doorways are too small, you may need to modify your order to a “ready to assemble” cabinet that can be built inside of the kitchen.
  • Space to park the truck, preferably in a driveway
  • Snow and ice cleared from the walkways and stairs
  • 10’ X 10’ of open space, or approximately the size of a car

*There is a 5 day time period to make sure you inspect and report any problems with your new cabinets.  You are required to inspect your shipment for any noticeable damages.  Installation dates do not change this 5 day window.

THE SALES ORDER

As the customer please take a few minutes to check the list of items on the sales order that you have received from your sales rep, and make sure it is correct.  In signing this document, you are agreeing that the order is correct.

TERMS AND CONDITIONS OF SALE

THE CUSTOMER (“YOU” OR “CUSTOMER’1 AGREES TO BE BOUND BY THESE TERMS AND CONDITIONS, WHICH, IN ADDITION TO THE TERMS INCLUDED WITH THIS DOCUMENT CONSTITUTE THE ENTIRE CONTRACT BETWEEN YOU AND IN STOCK KITCHENS (“ISK”). NO MODIFICATIONS TO THESE TERMS AND CONDITIONS, AND NO WAIVER THEREOF, SHALL BE EFFECTIVE AGAINST ISKC UNLESS IN WRITING AND SIGNED BY AN ISK AUTHORIZED REPRESENTATIVE.

ORDER ACCEPTANCE POLICY

ISK reserves the right at any time to accept or decline a Customer’s order for any reason, including lack of availability of products, failure by the Customer to satisfy payment terms, or when a product is quoted at an incorrect price due to typographical error (for example, in an advertisement) or error in pricing information.  ISK reserves the right to adjust or cancel quotations as required.

TERMS OF PAYMENT

Terms of payment are within ISK’s sole discretion.  Unless otherwise agreed to by ISK, all orders require a 100% payment at the point of sale and authorized or secured in a form of payment approved by ISK.

MEASUREMENTS

It is the sole responsibility of the customer to provide correct measurements.

DESIGN

ISK will design according to the customer provided measurements.  Design changes made after confirmation of delivery will incur a “change order” fee of 5%, plus a restocking fee of 25% for any items returned to ISK.  ISK does not guarantee or take responsibility for the measurements on the floor plan.  Please have your contractor verify measurements for accuracy prior to scheduling delivery as well as checking over the list of product purchased to make sure all desired materials are listed.  Customer will assume responsibility for cost of additional materials, restocking fees and freight charges associated with changes made to the floorplan.  ISK is not responsible for changes made to layout on site, that are not indicated on the floor plan.

RETURN POLICY

The Customer may return any permissible items provided the return is made prior to installation, without damage. Such items returned will incur a 25% restocking fee; and all returns may be subject to additional fees for, for example, damage or freight charges. No refunds will be made if the product returned is missing any parts or for items not normally carried in stock (i.e., “special order products”) or items shipped from third parties. All products will be inspected on return before RMA credit is authorized. All replacement requests must be made within five days of delivery. Items for replacement and return authorization requests must be inspected before a replacement can be completed. ISK is not responsible for installation or modification of any replacement/exchanged items. Replacement/Return items must be returned to the ISK support center for inspection before a replacement item or return authorization can be provided to customer. If an item cannot be returned to the ISK support center at the time of inspection, a photograph of the damaged or defective product must be provided along with reason of return/replacement for review and approval of replacement. No alterations will be accepted (cutout, drilled, marred, scraped and the like) without the consent of an ISK customer care representative.

WARPED DOOR POLICY

If you feel that you have a warped door, ISK requires that you perform initial testing to determine the extent of the problem. Remove the door from the cabinet and remove all decorative surface knobs and hinges. Please place the door on a completely flat surface. If you observe a gap between the door and flat surface, measure the distance to determine the amount of warpage. A door must be warped at least ¼” before it can be considered for replacement (a photograph will be required). If the door is warped less than ¼”, the customer agrees to allow a complete heating and cooling cycle (summer to winter) to allow the door to reach moisture equilibrium.

CANCELLATIONS

Customers may cancel orders without charge within 5 days of placing an order.  Any order cancelled after 5 days but before we confirm delivery will be charged a 5% re-stocking fee.  ORDERS MAY NOT BE CANCELLED AFTER WE HAVE CONFIRMED DELIVERY OF THE PURCHASED ITEMS.

TAXES

Customer shall pay to ISK any and all sales taxes, excises or other charges upon, or measured by the production, sale, transportation, delivery or use of the merchandise sold that ISK is required by any national, state or local government to pay or to collection.

SHIPPING, HANDLING AND DELIVERY

We can ship items to the 48 contiguous states in the USA, known as the Continental USA and Canada. Any statements made about delivery times are estimated and not guaranteed. ISK cannot be held responsible for any delays in delivery of your furniture for any reason. Customer may not cancel an order for failure to meet estimated delivery dates and the time it takes for delivery will vary based upon the manufacturer.

Title to the materials shall pass from ISK to Customer F.O.B. Shipping Point,  i.e., at the loading dock of ISK or the manufacturer’s loading dock if the product is shipped to the Customer direct from a source other than ISK. In other words the Customer bears the risk of loss while the product is in transit however ISK shall remain responsible to see to it that the correct product was shipped.

Force Majeure:  Delay in delivery or non-delivery in whole or in part by ISK shall not be a breach of the sale if performance is made impracticable by the occurrence of any one or more of the following contingencies, the non-occurrence of which is a basic assumption or which the agreement is made: (a) fires, floods, or other casualties; (b) wars, riots, civil commotion, embargoes, governmental regulations or martial law; (c) ISK’s inability to obtain necessary materials (finished or otherwise) from its usual sources of supply; (d) shortage of cars or trucks or delays in transit; (e) existing or future  strikes or other labor troubles affecting production or shipment, whether involving employees of ISK or employees of others, and regardless of responsibility or fault on the part of the employer; and (f) other contingencies of manufacture or shipment, whether or not of a class or kind mentioned herein and not reasonably within ISK’s control.

LAW/ENFORCEMENT

This Purchase Agreement shall be enforced according to the laws of the Commonwealth of Pennsylvania. In the event ISK is required to enforce the terms of this Purchase Agreement or defend against lawsuit related to the

NATURAL WOOD CHARACTERISTICS

There are many species of wood. Each piece of wood is entirely unique – just as no two trees are exactly alike. From light to dark finished, the finest hardwoods have certain natural characteristics that cannot be hidden with a finishing process. These characteristics are apparent and are not to be misinterpreted as defects. Wood is a product of nature and as such will display natural characteristics and variances that are unique to each and every cut.

The most common grain patters are fine or straight, cross, wavy, or curly or arch.  Any or all of these grain patterns may be present in your cabinetry making it truly one of a kind!

Your cabinetry may also have some species characteristics like closed knots, a blackish- blue streak called mineral streak, telegraphing, where some darkened grain shows through the stain, or small brownish dots called birds eye. None of these characteristics are to be considered flaws, blemishes or imperfections, but rather, examples of the beauties of Mother Nature.

There will be a natural variation from door to door of glaze color highlights in the grooves of the door frame as well as “hang-up” in corners of the frame. Because of the hand applied nature and technique of this finish, no two doors will have the same level of glazing. It is therefore very important to look at your cabinetry as a whole rather than focusing on an individual door, as the mix or blend of all doors will present a balanced unique look.

Wood is a natural material and is in a constant state of expansion and contraction depending on your home’s relative humidity and temperature.  In colder temperatures door center panels may contract at a different pace to the stiles and rails but they will return to normal as it gets warmer.  This normal movement may cause some hairline cracks at the joints in a painted finish surface on doors, drawer fronts, and face frames. This is a natural occurrence and does not diminish or weaken the strength of the joints.

LIFETIME WARRANTY

In Stock Kitchens (“ISK”) warrants to the original consumer purchaser that all products ISK sells (“ISK Products’) will be free from defects in material and workmanship under normal use for as long as he/she owns the home in which the ISK Products are originally installed. This warranty is only applicable to ISK Products used in personal residences located within the United States and is not transferable to subsequent owners. ISK may require Proof of Purchase. Should defects in material or workmanship exist during the applicable warranty period in any ISK Product, ISK will elect at its discretion to either repair or replace the defective material or component, free of charge.

This warranty is expressly limited to repair or replacement of the defective part at ISK’s discretion, and does not include labor for removal or replacement, or for other expenses such as the cost of removal, transportation, re-installation, overtime labor, etc. This warranty covers only parts and materials of ISK products.  This warranty does not cover counter tops, appliances, plumbing fixtures, backsplashes, flooring, etc. or the costs, including labor, to remove and reinstall such items and related components such as fittings, appliances, etc.  This warranty shall become void if the cabinets are in any way modified, improperly installed or damaged during installation. Furthermore, this warranty does not cover damage resulting from normal wear and tear, accident, misuse, abuse, dirt, water, tampering, un-reasonable use, neglect, acts of God, and exposure to extreme temperatures, or servicing performed or attempted by unauthorized service agencies, or for units that have been used for commercial purposes.

All wood varies in color, characteristics and show changes as they age. Sunlight, smoke, household cleaners and other environmental conditions may also affect the color match over time. These variations are considered to be the nature of the material in relation to their environmental exposure and are not covered under this warranty. Since wood naturally expands and contracts, the joints on a painted door do the same, as a result, you may see hairline cracks in the finish surface.  These joint lines are normal and do not affect the strength of the door’s construction.

The repair(s) or replacement(s) are contingent upon the current product offerings of styles and construction options within the In Stock Kitchens line at the time of the warranty claim. If a warranty claim is filed after an In Stock Kitchens

product becomes obsolete, ISK reserves the right to honor the warranty in one of the following fashions: to replace the affected component with a new component of the same style, or to replace the affected component and any other component(s) in the residential application to achieve a uniform appearance with a similar and comparable product style of the originally purchased style.

ISK reserves the right to alter design, specifications and material without obligation to make similar changes to products previously manufactured. If components are replaced, ISK cannot guarantee that the finish of these replacements will exactly match the finish and appearance of the components in the residential application. This is due to the changes that occur during   the woods’ natural aging process, affecting its color and grain.

THIS WARRANTY IS THE EXCLUSIVE WARRANTY OF IN STOCK KITCHENS WITH RESPECT TO OUR PRODUCTS. ISK DISCLAIMS ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT SHALL ISK BE LIABLE FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES TO THE PURCHASER OR ANY THIRD PARTY, INCLUDING, WITHOUT LIMITATION, DAMAGES ARISING FROM PERSONAL INJURY, LOST PROFITS, LOSS OF BUSINESS OPPORTUNITY, LOSS OF PROPERTY, ECONOMIC LOSSES, OR STATUTORY OR EXEMPLARY DAMAGES, WHETHER FROM NEGLIGENCE, WARRANTY, STRICT LIABILITY OR OTHERWISE.

This warranty gives you specific legal rights, and you may also have other legal rights which vary from state to state. Some states do not allow the exclusion or limitation of incidental or consequential damages, or limitation on how long an implied warranty lasts, so the above limitations or exclusions may not apply to you.
